Terms of Service

By accessing or using PolishReady (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to all of these Terms, you must not use the Service. Your continued use of the Service following the posting of revised Terms constitutes your acceptance of those changes.

These Terms constitute a legally binding agreement between you and PolishReady. Please read them carefully before using the Service.

PolishReady provides Electronic Services (usługi świadczone drogą elektroniczną) in the form of AI-powered digital content and preparation tools for Polish language certification exams, including reading comprehension, listening, grammar, writing, and speaking exercises. The Service constitutes digital content within the meaning of the Act of 30 May 2014 on Consumer Rights (Dz.U. 2014 poz. 827, as amended).

The Service is available through our website and includes both free and paid subscription tiers.

We reserve the right to modify, suspend, or discontinue any aspect of the Service at any time, with or without notice, and without liability to you or any third party.

You must be at least 16 years of age to use this Service. By using the Service, you represent and warrant that you meet this age requirement. If you are under 18, you represent that you have obtained verifiable parental or legal guardian consent to use the Service and that your parent or guardian has read and agrees to these Terms on your behalf.

• You are solely responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.
• You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate and complete.
• You must notify us immediately at support@polishready.pl of any unauthorized use of your account or any other breach of security.
• We reserve the right to suspend or terminate your account at our sole discretion, with or without cause, and with or without notice, for any reason including but not limited to violation of these Terms.
• You may not use another person's account without their express permission and our prior written consent.

• Paid subscriptions are billed on a recurring basis (monthly or annual) through Stripe. By subscribing, you authorize us to charge your designated payment method on a recurring basis until you cancel. All prices are denominated in Polish Zloty (PLN).
• No Refunds. All fees are non-refundable except as expressly required by applicable law. No partial refunds are provided for unused portions of a billing period.
• You are responsible for keeping your payment information current. If payment fails, we may suspend or downgrade your account after reasonable attempts to collect payment.
• We reserve the right to change subscription pricing at any time. For existing subscribers, price changes will take effect at the start of the next billing cycle following at least 30 days' notice.
• Cancellation takes effect at the end of the current billing period. You will retain access to paid features until the end of the period for which you have already paid.

The free tier of the Service is provided at our sole discretion and may be modified, limited, or discontinued at any time without notice. Free-tier users are subject to usage limits that we may adjust without prior notice. We make no guarantees regarding the availability, features, or continuation of free services.

• You retain ownership of content you upload to the Service, including essays, audio recordings, and images.
• By uploading content, you grant PolishReady a non-exclusive, worldwide, royalty-free, sublicensable, transferable license to use, store, process, reproduce, modify, and analyze your content for the purpose of providing, maintaining, and improving the Service, including training and improving AI models using anonymized and aggregated data derived from your content.
• You represent and warrant that you own or have all necessary rights, licenses, and permissions to upload your content, and that your content does not infringe or violate the rights of any third party.
• We may remove or refuse to process any content at our sole discretion, without prior notice and without liability to you.
• We are not obligated to store or maintain your content indefinitely. While we make reasonable efforts to preserve user data, you acknowledge that you are solely responsible for maintaining your own backups of any content you upload.

You agree not to:

• Use the Service for any unlawful purpose or in violation of any applicable local, national, or international laws or regulations.
• Upload content that is defamatory, obscene, threatening, harassing, or otherwise objectionable.
• Attempt to reverse-engineer, decompile, disassemble, or otherwise derive the source code of any aspect of the Service.
• Use automated tools, bots, scrapers, or similar means to access or interact with the Service without our express written permission.
• Circumvent, disable, or interfere with any security, access-control, or rate-limiting features of the Service.
• Share, transfer, or sell your account credentials, or allow others to access the Service through your account.
• Resell, redistribute, or commercially exploit the Service or any content, materials, or data obtained from the Service without our express written consent.
• Use the Service in any manner that could damage, disable, overburden, or impair our servers, networks, or infrastructure.
• Engage in any activity that interferes with or disrupts the Service or the experience of other users.

Violation of this Acceptable Use policy may result in immediate termination of your account without notice or refund.

All content, features, functionality, software, designs, text, graphics, trademarks, service marks, logos, and other intellectual property associated with the Service are and remain the exclusive property of PolishReady or its licensors and are protected by applicable intellectual property laws.

Nothing in these Terms grants you any right, title, or interest in our trademarks, logos, or brand features without our prior written consent.

Any feedback, suggestions, ideas, or other submissions you provide to us regarding the Service may be used by us without any obligation of compensation, attribution, or confidentiality to you. You hereby assign to us all rights in such feedback.

• The Service uses artificial intelligence, including third-party AI models (such as Google Gemini), to generate feedback on writing and speaking exercises.
• All AI-generated feedback is provided strictly for educational and practice purposes and must not be relied upon as a definitive or authoritative assessment of your language proficiency.
• We do not guarantee the accuracy, completeness, reliability, or suitability of any AI-generated content for any purpose.
• AI-generated feedback does not constitute a professional evaluation and is not a substitute for assessment by a qualified language instructor, examiner, or official certification body.
• PolishReady makes absolutely no guarantees, representations, or warranties regarding your performance on any official Polish language certification exam, including but not limited to exams administered by state certification commissions.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW:

• Our total aggregate liability to you for all claims arising from or related to the Service or these Terms shall not exceed the total amount you have actually paid to us in the twelve (12) months immediately preceding the event giving rise to the claim, or fifty (50) EUR, whichever is greater.
• In no event shall we be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, including but not limited to loss of profits, loss of data, loss of use, loss of goodwill, cost of procurement of substitute services, or any other intangible losses, regardless of the theory of liability (contract, tort, strict liability, or otherwise) and regardless of whether we have been advised of the possibility of such damages.
• We shall not be liable for any damages resulting from: (a) your use of or inability to use the Service; (b) any unauthorized access to or alteration of your data or transmissions; (c) any statements, conduct, or content of any third party on or through the Service; (d) any AI-generated feedback or content; (e) any interruption, suspension, or cessation of the Service; (f) any errors, viruses, or inaccuracies in the Service.

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY. WE EXPRESSLY DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

WE DO NOT WARRANT THAT: (A) THE SERVICE WILL MEET YOUR REQUIREMENTS OR EXPECTATIONS; (B) THE SERVICE WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE; (C) THE RESULTS OBTAINED FROM THE USE OF THE SERVICE WILL BE ACCURATE, RELIABLE, OR COMPLETE; (D) THE QUALITY OF THE SERVICE WILL MEET YOUR EXPECTATIONS; OR (E) ANY DEFECTS OR ERRORS IN THE SERVICE WILL BE CORRECTED.

You agree to indemnify, defend, and hold harmless PolishReady, its owners, officers, directors, employees, agents, contractors, and affiliates from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees and court costs) arising out of or related to: (a) your use of or access to the Service; (b) your violation of these Terms; (c) your violation of any rights of any third party, including intellectual property rights; (d) any content you upload, submit, or transmit through the Service; or (e) your negligent or willful misconduct.

This indemnification obligation will survive the termination of these Terms and your use of the Service.

• We may suspend or terminate your access to the Service immediately, without prior notice or liability, for any reason or no reason, at our sole discretion, including but not limited to breach of these Terms.
• Upon termination, your right to use the Service ceases immediately. You will not be entitled to any refund of fees already paid.
• We may, at our sole discretion, delete your account and all associated data after a reasonable retention period following termination, subject to our Privacy Policy and applicable legal retention requirements.
• Provisions of these Terms that by their nature should survive termination shall survive, including but not limited to: Limitation of Liability, Disclaimer of Warranties, Indemnification, Intellectual Property, Governing Law, and Dispute Resolution.
• We shall not be liable to you or any third party for any suspension or termination of your access to the Service.

These Terms shall be governed by and construed in accordance with the laws of Poland, without regard to its conflict of law provisions. You irrevocably agree to submit to the exclusive personal jurisdiction of the courts located in Warsaw, Poland for the resolution of any disputes arising out of or relating to these Terms or your use of the Service.

Before initiating any legal proceedings, you agree to first attempt to resolve any dispute informally by contacting us at support@polishready.pl. If a dispute cannot be resolved informally within thirty (30) days of your initial notice, either party may pursue formal legal proceedings in accordance with Section 15 above.

To the fullest extent permitted by applicable law, you agree that any claims arising from or related to the Service must be brought in your individual capacity only, and not as a plaintiff or class member in any purported class, collective, or representative proceeding.

We reserve the right to modify these Terms at any time at our sole discretion. We will indicate material changes by updating the "Effective Date" at the top of these Terms. It is your responsibility to review these Terms periodically. Your continued use of the Service after any modifications are posted constitutes your binding acceptance of the revised Terms. If you do not agree to the revised Terms, your sole remedy is to discontinue use of the Service.

If any provision of these Terms is found by a court of competent jurisdiction to be invalid, illegal, or unenforceable, such provision shall be modified to the minimum extent necessary to make it valid and enforceable, or if modification is not possible, shall be deemed severed from these Terms. The invalidity or unenforceability of any provision shall not affect the validity or enforceability of the remaining provisions, which shall continue in full force and effect.

The Service provides digital content within the meaning of the Act of 30 May 2014 on Consumer Rights (Ustawa o prawach konsumenta, Dz.U. 2014 poz. 827, as amended).

Waiver of Right of Withdrawal (Art. 38 pkt 13): By purchasing a subscription and clicking "Upgrade," "Start Lesson," or "Access Content," the User explicitly requests immediate performance of the contract and acknowledges the loss of the 14-day right of withdrawal from the contract, in accordance with Art. 38 pkt 13 of the Consumer Rights Act. This waiver applies once digital content delivery has commenced.

Before completing any purchase, you will be asked to separately confirm: (a) acceptance of these Terms and the Privacy Policy; and (b) your explicit consent to immediate access and waiver of the 14-day withdrawal right. Both confirmations are required before payment can proceed.

These Terms, together with the Privacy Policy and any other legal notices, policies, or agreements published by us on the Service, constitute the entire agreement between you and PolishReady regarding your use of the Service. These Terms supersede all prior and contemporaneous agreements, understandings, negotiations, and communications, whether oral or written, regarding the subject matter hereof. No waiver of any term or condition of these Terms shall be deemed a further or continuing waiver of such term or any other term.
